Terms for using Daymark
These Terms of Service govern your access to and use of Daymark. By using the service, you agree to the terms below.
Agreement to the Terms
By accessing or using Daymark, you agree to these Terms of Service and any updates posted here. If you are using the service on behalf of an organization, you represent that you have authority to bind that organization.
Accounts & Access
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and keep your account details up to date.
Subscriptions & Billing
Paid plans are billed in advance on a recurring basis. You authorize us to charge your payment method for all applicable fees and taxes. Fees are non-refundable except where required by law or explicitly stated otherwise.
Acceptable Use
You agree not to misuse the service, including attempting unauthorized access, interfering with normal operation, or using the platform to transmit unlawful, harmful, or infringing content.
Customer Data
You retain ownership of the data you submit to Daymark. You grant us the rights needed to host, process, and display your data solely to provide the service and improve the platform. Daymark does not use Customer Data to train general-purpose AI models without your permission.
Security & Privacy
We implement industry-standard safeguards to protect your data. Our Privacy Policy explains how we collect, use, and secure information related to your use of the service.
Service Availability
We strive to keep Daymark available, but downtime may occur for maintenance, upgrades, or circumstances outside our control. We are not liable for service interruptions beyond what is required by law.
Intellectual Property
Daymark and its content, software, and branding are owned by Daymark or its licensors. You may not copy, modify, or distribute the service except as expressly permitted in these terms.
Termination
You may cancel your account at any time. We may suspend or terminate access for violations of these terms, non-payment, or security risks. Upon termination, your access to the service will end. After termination, we will delete or anonymize Customer Data within 30 days, unless retention is required by law. You may request an export before deletion.
Third-Party Services & Integrations
You may connect third-party tools or services to Daymark, and those services are governed by their own terms. Our service may rely on third-party providers and integrations, and we are not responsible for outages or API changes outside our control. To provide the service, LLM providers such as OpenAI, Anthropic, and Google may process Customer Data, and our configurations and contractual terms restrict those providers from using Customer Data for training.
Disclaimers
The service is provided on an “as is” and “as available” basis without warranties of any kind. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law, Daymark will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill.
Indemnification
You agree to indemnify and hold Daymark harmless from claims arising out of your use of the service, your content, or your violation of these terms.
Governing Law
These terms are governed by the laws of India, without regard to conflict of law principles. You agree to the exclusive jurisdiction and venue of the courts in Surat, Gujarat, India.
